Brazil Jurisdiction-Specific Terms

Under the LGPD, the Parties agree that Customer is a Controller and further that the Brazilian SCCs shall be completed as follows:  

• Clause 1 of Section I of the Brazilian SCCs shall be deemed completed with the information set out in Appendix A to DPA.

• Clause 2 of Section I of the Brazilian SCCs shall be deemed completed with the information set out in Appendix A to DPA.

• Clause 3 of Section I of the Brazilian SCCs:  Option B shall apply.

• Clause 4 of Section I of the Brazilian SCCs:    The Parties select the Exporter for purposes of sub-sections 4.1(a)-4.1(c). 

• Section III of the Brazilian SCCs shall be deemed completed with the information set out in Appendix B to DPA (Organizational and Technical Measures). 

• Section IV of the Brazilian SCCs shall be deemed completed by the following:  Not applicable.

Signatures to the Agreement shall constitute all necessary signatures to the Brazilian SCCs, including the appendices attached thereto. 

The most current version of this document shall be such in effect as of 12:00am EST (Eastern Standard Time) of the date stamped on such online version.
